There are three kinds of Power of Attorney in Ontario: the Power of Attorney for Personal Care, the General Power of Attorney for Property and the Continuing Power of Attorney for Property. A Power of Attorney for Personal Care (some- times called a "personal power of attorney") is a legal document. With this document you give someone the power to make personal care deci- sions on your behalf if you become mentally incapable making them yourself. This person is called your "Attorney". (He or she is not usually a lawyer -- in Canada the work "attorney" does not mean a lawyer, as it does in the U.S.A.). Personal care decisions are decisions about your health care (including medical treatment), diet, housing, clothing, hygiene and safety. If you become mentally incapable of making personal care decisions, someone else must make them for you. This. person is called your "substitute decision-maker". For some decisions, including those about your medical treatment, the law requires your doctor and other health care providers to get your substitute decision-maker's consent before taking action. | Giving a Power of Attorney for Personal Care is also a way to make sure that your wishes about personal care decisions will be respected. It gives you a chance to say what you want and what you do not want. For example, if you don't want certain medical treatments in the event of a serious illness, you can make this clear in your Power of Attorney. A Continuing Power of Attorney for Property and a General Power of Attorney for Property each give someone the power to make decisions about your finances, home, and possessions.
