When does a Power of Attorney for Personal Care take effect? It takes effect only if you become mentally incapable of making some or all of your per- sonal care decisions. (A Continuing Power of Attorney for Property, on the other hand comes into effect as soon as it is signed and witnessed, unless you state otherwise.) Who would decide that I'm incapable of mak- ing personal care decisions? It depends on the situation. In most cases, your attorney would decide this unless you name someone else in you Power of Attorney to "confirm" your incapacity. If you do this, your attorney cannot start mak- ing personal care decisions for you until that other person confirms that you are incapable of making decisions. If your Attorney thinks you may be incapable, they must arrange for the ap- propriate person to assess you and confirm your incapacity. Who can I name to confirm my mental incapac- ity? You can name your family doctor, another health professional, even a personal friend to confirm your incapacity. Or you can specify a certain kind of professional: a social worker, psychologist, or nurse, for example. Can anyone else decide that I am mentally inca- pable of making personal care decisions? Yes. Sometimes the decision that you are mentally incapable is not up to your attorney or anyone you name. This is true in situations concerning your: *health treatment *admission to a long-term care facility, or *need for personal assistance services (bathing and eating for example) while in a long-term care facility. Next General Meeting: Tonight: Thursday, Feb- ruary 3 at 7:30. Yours in Comradeship, LA President Peggy Harris Local people spot lots of robins Who has spotted the first robins, long considered a real harbinger of an early spring? Mr. and Mrs. Bill Patter- son spotted two red breasted robins at their home on Crewson Line, west of Acton, on Sunday, Jan. 30 about 10:40 a.m. Meanwhile eight mem- bers of the Acton Seniors hiking club enjoying a trek through the Rockwood Conservation Area on Fri- day, Jan. 28, said they saw a flock of at least nine robins in the park: Proof? Eileen Dix took some photos of the birds. Early spring or mixed-up birds? It's known that some robins miss the annual mi- gration south. They stick around for the winter, usu- ally when they can perch in a sheltered spot and are assured of a daily food sup- ply. However, they are few and far between, so perhaps the Patterson and seniors sightings of the rare birds is a harbinger of an early spring.
