At a recent Town Council meeting, Rob Ustrzycki, the Towns manager of bylaw enforcement, said the provincial legislation is more restrictive than the Towns for restau- rants and bar patios. For example, the simple fact that it has a roof, partial or complete, is the only essential element thats required where smoking under those circumstances is prohibited, so essentially it can be a gazebo that has a roof, that has no sides to it but under the provincial legislation (smoking) would be prohibited, he said, adding under the Towns bylaw, smoking would be allowed. Ustrzycki said after May 31, local health officials would carry out inspections, investigate complaints of non-com- pliance and enforce the new Smoke Free Ontario Act.
