One of the most frequent traffi c complaints received by police in the summer time relates to off road vehicles. An off road vehicle includes motorized scooters, dirt bikes, all-terrain vehicles and pocket bikes. The following rules should be remembered should you decide to use your off road vehicle: ? Persons under the age of 12 are not permitted to use off road vehicles. ? If these vehicles are driven on a highway (any street or roadway), the driver is required to hold a valid licence. ? The off road vehicle must bear a number plate and be covered under a valid insurance plan. ? Any person that drives an off road vehicle MUST wear a helmet ? THE OWNER OF THE VEHICLE MAY BE CONVICTED FOR OFFENCES COMMITTED BY THE DRIVER. ? Permission from the owner of the land where the vehicle is to be driven is required before it is used. ? Under the Trespass to Property Act, any fi eld used for farming is presumed to be of limits, even if it is not specifi cally signed. ? The driver of such a vehicle is required to stop for police. Failure to do so will result in arrest and more serious charges being laid. The very nature of these vehicles causes them to create more noise than normal; therefore, if your vehicle causes exceptional noise, the noise problem should be corrected before using it on a roadway. If this noise issue is not corrected, the driver could be charged with creating unnecessary noise. Most of these listed infractions will result in a fi ne of about $110.
