acquitted Leonard Cripps has been acquitted of second degree murder charges in the fiery August 19 1979 death of Howard Gibbons Cripps was charged in December 197J along with codefendants Mercun and Michael MeCnstall alter fire levelled the Dominion Hotel resulting in the death of Gibbons Monday as the now infamous trial entered its fourth week Mr Justice Coulter Osborne told the jury he had reviewed the evidence of the trial as it relates to and reached the conclusion that evidence cannot be elevated to the point of Justifying conviction He directed that a verdict of not guilty be returned The jury all nodded their heads in agreement and was allowed to leave the courtroom lawyer Peter K McWilliams made the application for dismissal of the charges Follow the decision he pointed out the case is Illustrative of the fact more than just at the scene is required especially where evidence is based on circumstantial evidence He told reporters in the hall afterwards there has to be some evidence of some act of McWilliams said when he made the Hon for dismissal he was hopeful Cripps would be released Granting of directed verdicts does not happen often McWilliams said Cripps feels pointed out what did not come out in the trial was the fact had had a mild stroke two weeks before the fire and had returned to work the night before the fire Mr Justice Osborne in delivering his up to the sec floor were hampered by tht smoke said In his cross examination Mithael lold threatened to get back at Mercun for kicking him out of the hotel Engleby denied the charge inquired if had gone in the parking lot of the hotel that night The answer was no He revealed he was planning on spending the night with Joe and Howard Gibbons On her second day on witness stand Heather More I and admitted she perjured herself at the pre hearing when she claimed the police put words in her mouth and were acting superior pointed during Tuesday lest imony Morcland said Mercuri treated and Cripps
