that the owners did not know of the first hearing he added Although approval for the township Restricted Area bylaw has been approved by the Ontario Municipal Board the Board reserved decision on after a series of legal sparring matches bet ween counsel for the Dragway and solicitors for the township the North Esquesing Ratepayers Association and Charles leaving the drag- way zoning still unsettled Mr ruled lhat the bylaw merits careful con sideration and although he predated the Inconvenience adjournment of the hearing would cause proper evidence must be shown before the board could moke a decision He said the issue was In the fact the township applied for the by law approval and the municipality must show the O M B why the by law should apply to the Golden Horseshoe Dragway NO EVIDENCE Since there was no evidence here the O M B would adjourn Ihe hearing until such time as evidence was available and then Ihe township could apply for a new hearing date Township solicitor Terry Balnea testified he could have competent professional evidence on he stand within an hour but Walter counsel for the said it would be at least two weeks before he could assemble suitable
