Rent control and what it means to you By MONTE COMPTON The rents that may be charged for most residential rental units are now controlled by Ontarios new Residential Tenancies Act 1970 The Act governs he frequency and amount of rent Increases and establishes a Residential Tenancy Commission with local offices throughout Ontario to administer this rent review program The Act applies to rent increases tak ing effect on or after Dec Before your landlord can impose a rent increase of any amount he or she must provide you with a standard Notice of Rent Increase Form 1 at least days before the da on which the increase Is to take effect This notice must state the intended increase both in dollars per month and as a percentage of the current rent as as the effective date of the proposed increase If the notice Is not served within the required time the Increase is void and you do not have to pay It The rent for an Individual unit may not be increased more than once in any 12- month period Since rent con rob apply to the premises the landlord cannot raise the Legally Speaking rent even when a new tenant moves in if rent on that apartment has been increased any time within the lost year The landlord can never raise the rent on your apartment by more than six percent unless the Tenancy Commission authorizes the increase Authorization must bo sought no later than days before the intended date of the proposed Increase A copy of the appli cation must be served on the tenant of the unit concerned The landlord must satisfy the Commission that the cost of operating the rental premises Justifies the proposed rent increase If the landlords costs have or will increase a rent Increase above six percent may be justified Whenever your landlord applies for a rent increase above six percent the Commission will hold a hear ing on the matter At this time you can present reasons why Experience 81 means jobs that are meaningful the increase should not be allowed You may also apply to the Commission to dispute a reposed increase in rent clow six percent To do this you must file with the commis sion a Tenants Application for Review of Intended Rent Increase Form 3 no later than days before the effect ive date of the proposed increase You must give a copy of the application to your landlord The Commission will first attempt to mediate the dispute between you and your landlord to see If some agreement can be reached If not Commis sioner will conduct a hearing to review the proposed increase Both you and the landlord will have an oppor tunity to submit evidence or arguments for or against the rent increase The Commis sioner will then decide what Increase if any is to be allowed You have the right to appeal any decision of the Commis sion To initiate an appeal a Notice of Appeal must be fifed with the Commission within IS days of receiving the decision An appeal panel will hold another hearing to review the appeal The panel may affirm the Initial decision of the Commission or issue a differ ent decision Although most residential rental premises arc subject to this rent review scheme not all arc Premises exempt from rent review Include a renlal unit In a building part of which was occupied a rental unit before Jan 1078 a renlal unit in which the monthly rent is or more premises used for both residential and commercial purposes when rented under a single lease such as a store an upstairs apartment It occupied by the same people transient or seasonal accommodation In hotels or vacation homes form employees accommo dation located on or off the farm any unit provided by an educational Institution for lis students or staff If there has been consultation regard ing a rent Increase with an association representing the residents a rental unit in a resi dential building operated by or on behalf of the federal pro vincial or municipal govern ments or any of their agen cies a renlal unit in a building owned operated or administe red by a
