has reversed its decision to appeal a Land Division Commit tee ruling on two lot severances to the Ontario Municipal Board Town council last week voted to appeal land severance applications by Chateau Bel air Developments and Ronald McGowun to the OMB The applicants want severances for two lots one of which fronts onto Confederation Street In Glen Williams But the other lot has only a right of way over the first tot Because it does not front onto a public street which Is against town policies Halton Hills was going to appeal the decision approving the severances to the But lawyer Bert Arnold appeared before council Monday to explain that the severances were merely technical changes not physical ones There Is a subdivision planned for the area which would allow both lots to front onto a street In the slo said Mr Arnold The lot severances were to allow Chateau Developments to own the end lot fronting on the public street thus assuming for creating the open road allowance he said Not allowing the severances would forte the end Tot to be In the name of Mr McGowan and that may a big financial hardship If he has to post letters of credit for parts of the sub division said Mr Arnold Town Deputy Planner Bruce Mac Lean said council should take As a planning principle we would not suggest you go around creating lots without frontages on public roads said Mr Maclean Coun Betty Fisher said every developer must be treated equally by council Equal situations should be dealt with equally and unequal situations should be dealt with unequally replied Mr Arnold Even if the subdivision t go ahead there will be no physical changes in the land said Mr Arnold Only the lot owners names will have changed The second lot will still have a way over the first he said He said the Intent of the official plan which says lots should front on to a public road Is to deal with new s tua Lions This situation Is not new he Bald But Mr MacLean said council would be creating new lots therefore it Is a new situation Council must decide whether or not the technicality outweighs the policies of the official plan said Mr MacLean Councillors rescinded their motion of April to go to the Town agrees to
