THE HERALD Wednesday June 1S91 Page Council Briefs Town to finish subdivision work Halton Hills Council approved Monday the Town spend an extra to finish public services work concerning the subdivision Halton Hills Estates in Stewart- town The work includes storm sewer cleaning installation of culvert grates installation of chain link fences lot drainage im provements minor lot grading and driveway paving within the roadway rightofway according to the staff report This and other work was outlin ed in the subdivision agreement signed between the Town and the developer Halton Hills Develop ment Corporation The agree ment also included a letter of credit for the Town could access if the developer was unable to finish the work outlined in the agreement The developer ran into finan cial difficulties in April and the Town subsequently took over the remaining amount of work according to the staff reports author Town Administrator- Clerk Dan Costea However Mr told coun cil the remaining work will total more than was allocated to the Town through the letter of credit Council decided all of the re maining work was essentia ex cept boulevard tree planting As a result the cost for tree planting was subtracted from the amount of extra money approv ed Mr Costea said that legally the Town is only obligated to do the amount of work covered by the letter of credit But he felt the Town has a moral obligation to do all of the necessary work Acton Coun Gerald agreed so much so that he voted against the tree planting cost be ing eliminated Coun Pat McCarthy voted against the money being spent because he objected to the Town paying for driveway paving within the road rightofway Council sides with church Halton Hills Council decided Monday that several requests by St Johns United Church on Guelph Street in Georgetown con cerning the churchs renovation project could be better handled by the Towns Site Plan Commit tee That committee deals with design details ot construction projects Church representative Andrew told council members Monday the church had already approached Site Plan Committee about the pro ject and at that time the commit tee said a building permit wouldnt be issued until the church agreed to fulfill certain requirements Mr Leverette said the re quirements which all relate to the renovation works should either be eliminated or deferred He stressed the church is operating under financial con straints and therefore the re quirements should be considered in the context of these con straints Acton Councillor Gerald nie echoed the sentiments of the other councillors when he said the churchs request should be sent back to Site Plan Committee and committee members should take into consideration that the church is a nonprofit group that serves the community Report requested Town staff was directed Mon day by Council to write a report on whether local developer Al Pilutti should be permitted to sever a piece of property in Glen Williams west of Road Mr Pilutti told Council he wants to sever the property to build two houses Before Mr is permitted to sever the property Council must lift a development freeze for the Glen Williams hamlet area The freeze was imposed last year to give Town staff time to complete a storm sewer study The study has yet to begin because of a lack of Town funds said Town Engineer Bob Austin is generally acknowledged if the Third Line was redirected through the quarry then the dump proposal would get caught up in bureaucratic red tape for years to come As it stands now the dump pro posal is expected to go before the Ministry of Environment late this year for final consideration Contacted Mayor Miller said the Town has directed its lawyers to determine if the agreement with is legally binding The lawyers have so far said the Towns case is weakened because the agreement has not been registered in title Asked why the agreement wasnt registered Mayor Miller replied it was a lack of good ad ministration staff at the time Town AdministratorClerk Dan said the agreement isnt legally binding but we feel In has a moral obligation to follow through with the agree ment The controversy surrounding the agreement also involves the fact that when sold the property to United Aggregates in the mid80s the reconstruction of the Third Line was omitted from the purchase agreement No one appears to be able to justify this omission If the Town is right and the IndusminTown agreement is weakened because it wasnt registered then why was In dusmin allowed to start quarry ing activity in the first place questioned Mr Young If the agreement isnt legally binding then the Town should be able to take over the property and reconstruct the Third Line itself he said When asked if this would be possible given the property was purchased by United Ag gregates Mr Young speculated the agreement between United Aggregates and is not legally binding since the Town agreement with Indusmin wasnt
