"I can't carry laundry, I can't grab a jug of laundry detergent," said Pells. Her son has to grocery shop with her because she can lift only light items. She has to take one dish at a time from the cupboard and can't lift a pot of water or a crock pot. "If it (the mesh) had worked the way it was supposed to I could have done a little bit more," said Pells. Pells' mother informed her of the lawsuit after a friend of hers was researching the mesh on the Internet for himself. Pitch said the mesh had been in use in Canada since 2002, and most of it was withdrawn by Health Canada in 2006. According to the statement of claim, faulty mesh has been implicated in serious medical complications, including perforation of the bowels and/or chronic intestinal fistulae and patients have suffered internal bleeding, infections and in some cases, death. "The product is an innovative mesh that has a plastic ring that causes the mesh to flatten," said Pitch. He alleges the problem is actually with the ring that can deteriorate and get caught in internal organs "causing bowel perforations, abscesses and potentially life-threatening injury." Pitch added the material of the mesh also doesn't work well. He said the product was pulled initially in the U.S., then Canada, and the matter has been in litigation for years in the U.S. Pitch said there have been between 30 and 50 people who have filed complaints on the law firm's lawsuit website, but he believes there are thousands who have been affected. Pitch said the hope is to get the lawsuit certified in court by the end of February and if they can satisfy the court, to have it approved as a class action by fall. He said unlike some other lawsuits there aren't as many people affected by the Kugel Mesh, "but the affect on the people has been traumatic." Scott Lowry, Head of Media for Bard Inc. based in New Jersey, declined to comment Wednesday on the lawsuit saying, "we don't typically comment on litigation." Considering her condition at the time of the surgery Pells has fared relatively well in her recovery. But she still suffers pain. "I do still have pain daily, it starts out slow in the morning, by mid-day it increases, by night it is sometimes quite painful. It feels like I have strained myself and the abdominal area is very tired and sore."
