Pitch said the hope is to get the lawsuit certified in court by the end of February and if they can satisfy the court, to have it approved as a class action by fall. He said unlike some other lawsuits there aren't as many people affected by the Kugel Mesh, "but the affect on the people has been traumatic." Scott Lowry, Head of Media for Bard Inc. based in New Jersey, declined to comment Wednesday on the lawsuit saying, "we don't typically comment on litigation." Considering her condition at the time of the surgery Pells has fared relatively well in her recovery. But she still suffers pain. "I do still have pain daily, it starts out slow in the morning, by mid-day it increases, by night it is sometimes quite painful. It feels like I have strained myself and the abdominal area is very tired and sore."
