Claiming the Town acted in bad faith, RioCan Acquisitions asked the Superior Court of Justice to quash bylaws passed by the Town and Halton Region to allow Calloway REIT to build a 450,000-square-foot, $170-million luxury outlet mall in Hornby. RioCan, alleged the Town acted illegally for failing to meet statutory requirements and conditions in processing the Calloway application, and acted in bad faith for an improper purpose. RioCan had wanted the court to quash bylaws passed by the Town and Region, revoke all permits issued to date, or in the alternative, and issue an order for damages of $50-million.
