"It's quite variable. It can be quite precipitous and quick. A patient may be disoriented and confused and not know who he or she is." Approximately 20 years ago, Elson had a similar hypoglycemic episode at the Bacardi plant in which he stopped working, but then passed out and "split his head open" when he took a break to eat something and rest in the lunchroom. Defence attorney John Navarette said his client doesn't dispute "98 per cent" of the facts in the case, but said the crux of the issue is whether Elson was negligent in his actions. Since the accident, Elson has altered his treatment strategy and now has a glucometer at work to measure his blood-sugar level before leaving for home. During cross-examination, Crown attorney Laurie Jago focused on comments Elson made to a Halton Regional Police officer at the accident scene. Elson told the officer that had "three or four" similar episodes in the past in which he had "just made it home," but the events of May 27, 2010 were "like nothing I'd ever felt before" and that "I should have pulled over." Jago then asked Dr. Bain how long it would take for blood-sugar levels to rise after eating carbohydrates like a granola bar and he responded, "Five to 15 minutes." "The thing I'm a little confused about is that you kept driving," said Jago. "If someone was using heavy machinery and they felt `low,' they would stop work, correct? You're just (going by) the way you feel and experience is a good way to judge that...If someone was driving and they felt like that you would instruct them to pull over. It's standard education and common sense, especially if you had episodes like that in the past." Justice Leonard Ricchetti interrupted Navarette's closing argument that Elson's actions weren't negligent. "He had the wherewithal to eat a NutriBar and half a bun and realize he missed two turns," the judge said. "It doesn't take minutes to stop the car or pull over. Your expert said stop.
