Austin Elson, 64, had also been charged with failing to stop at an accident, but in Milton court Tuesday following a two-day trial last week Justice Leonard Ricchetti found Elson not guilty of that charge. It's expected the dangerous driving causing bodily harm charge will be stayed on the Kienapple principle, which precludes multiple convictions for the same action. Elson is to be sentenced December 7 in Brampton court. Elson, who has been taking insulin injections three times daily since being diagnosed with diabetes in 1977, had been driving home from work at the Bacardi Canada plant in Brampton at Steeles Ave. and Hwy. 410 on May 27, 2010. Shortly into the 15-minute drive to his residence near Chinguacousy Rd. and Queen St. W. he testified that he began to feel a blood-sugar "low," becoming confused and disoriented in what he called heavy traffic.
