What happens if I do not have a Power Of Attorney in place for my personal care? A: We In my last edition I explained the benefits of having a Power of Attorney for Personal Care (POAPC), and in this edition I can briefly advise what could happen if you do not have a POA in place. The purpose of a POA for Personal Care is so you can remain in control of your own future and state preferences for personal health care as you age and require more assistance. Through the Power of Attorney document, you would appoint a Substitute Decision- Maker (SDM) to make all your personal care decisions in the event you no longer can. Important decisions such as your health care treatments, your admission to retirement living or long-term care home or any other personal health assistance you might require. This is your opportunity to clearly express your wishes and avoid any uncertainty or disputes among family members. If you don't have a formal POA document in place, health care professionals refer to the list of Substitute-Decision Makers (SDM) according to the Health Care Consent Act: - Your spouse, common-law partner - Your children (over 16 yrs old) - Your parent with right of access only - Your brother or sister - Any other relative by blood, marriage or adoption - The Office of the Public Guardian and Trustee For several reasons, you might not want an SDM selected by default. If you are not close with them, they might not know what your specific health care wishes are and so might decide something that you are not happy with. For example, imagine being placed in a retirement home not of your choice or to be refused treatment that you would have wanted. If your wishes are not documented in writing through a POA, it will be up to the appointed decision-maker(s) to make them for you. Look after your best interest. When selecting your Substitute Decision Maker on your POA make sure it's someone that you trust and feel secure will follow through with your health care needs and wishes.
