The Amendment applies to the entire geographical extent of the Town of Caledon. OFFICIAL PLAN AMENDMENT: The purpose of this Amendment is to amend the parkland dedication and cash in lieu of parkland policies to best maximize the Town's ability to obtain parkland dedication and ensure conformity with the Planning Act. The amendment proposes to amend Section 6.2.12 of the Official Plan by amending existing as well as adding new policies. BASIS OF THE AMENDMENT: Official Plan Amendment No. 235 is the result of a review of the Town's current policies and procedures regarding the dedication of parkland. The basis for this Amendment is contained in Planning Report DP-2013-132, as adopted by Council on October 22, 2013. If you wish to appeal the decision of Council, a notice of appeal must be filed with the Clerk of The Corporation of the Town of Caledon no later than November 18, 2013. A copy of an appeal form is available from the Ontario Municipal Board website at www.omb.gov.on.ca or by contacting the Town Clerk. A NOTICE OF APPEAL MUST: 1. be in writing; 2. set out the reasons for the appeal and the specific part of the Official Plan Amendment to which the appeal applies; 3. be accompanied by the Ontario Municipal Board fee in the amount of $125.00, which can only be paid by certified cheque or money order made payable to the Minister of Finance, Province of Ontario; and, 4. be accompanied by the Town's fee in the amount of $150.00, which can be paid by cheque, payable to the Town of Caledon. The Official Plan Amendment is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal. Only individuals, corporations or public bodies may appeal a decision of the municipality or planning board to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
