Acton My husband and I have a Separation Agreement from 2013 when we separated. He is paying child support based on his 2013 income but I believe that his 2014 income was higher. He won't give me any details and won't agree to increase the child support. What do I do? ASK THE PROFESSIONAL If your husband won't agree to disclose his income and increase the child support, then you should complete an "Affidavit for Filing Domestic Contract or Paternity Agreement with Court" document and attach a copy of your Separation Agreement. Your signature on the Affidavit must be witnessed by a commissioner. The Affidavit should then be filed with the court in Milton if you reside in the Regional Muncipality of Halton. Once you have taken that step, the child support provisions can be changed as if they were a court order. The next step is to complete several forms and serve them on your husband and file them with the court. These documents include a Motion to Change, Change Information Form and possibly a Confirmation of Assignment Form and a Financial Statement if you are trying to change the amount your husband contributes to any special/extraordinary expenses such as daycare/ babysitting and children's activities. In addition to the above documents, you must provide him with a blank copy of a Response to Motion to Change, Consent Motion to Change and a Financial Statement. These forms can be downloaded at www.orgforms.gov.on.ca. Changing child support can be complicated so call me to set up a consultation and we can discuss your specific situation. 350 Rutherford Rd.
