How much should my employer pay me as a termination package? First, I am excited to announce that, as of October 1st, 2015, I will have office space in the Lounsbury Life & Group Insurance building at 8 Guelph Street, Georgetown. I have been helping employers and employees for nearly 20 years. Presumably, the termination is "not for cause" or "without just cause". Look at your employment contract first if you have one to see if there are provisions that limit your entitlement in the event of termination. If there is no limitation, then you look first to the Employment Standards Act 2000 ("ESA"). The ESA provides for the statutory minimums of what employees are entitled to as statutory notice and statutory severance (if certain criteria are met). You then look at the common law, i.e. what the courts have awarded in similar circumstances. The court applies the "Bardal" factors, which are based on a case from the 1960's, i.e. your age, length of service, position with the company, and the economy. You might also be entitled to the continuation of other "fringe benefits" for the duration of the notice period, e.g. bonus, RRSP contributions, benefits, car allowance, etc. If you have been terminated, or you are an employer considering terminating an employee, call me to find out how much the employee may be entitled to receive.
