Costs can be awarded following a motion or at trial. There is a presumption that a successful party is entitled to his or her costs. However, costs are ultimately at the discretion of the court. The court typically determines costs on the basis of different "scales". There is partial indemnity, or about 50% - 60% of a party's actual costs, and substantial indemnity costs, being approximately 75% of a party's actual costs. Sometimes there may be a mixed result, and no costs are ordered to be paid. Whether or not an offer to settle has been made is important when determining costs. If an offer to settle has been made "pursuant to the rules", i.e. it has met certain criteria, and a party meets or beats their offer on a motion or at trial, then the court can award a party his or her costs on a partial indemnity basis up to the point the offer was made, and then on a substantial indemnity basis from the date of the offer onward through trial. So you do not usually get all of your costs back. If a case settles amicably, costs usually do not get paid, or they are part of a global resolution.
