Is there anything I can do about it? Quite possibly. There is special legislation that deals with this sort of situation called the Occupiers Liability Act ("OLA"). What the OLA says is that an occupier of premises owes a duty to take such care as in all the circumstances of the case is reasonable to see that persons entering on the premises are reasonably safe while on the premises. It is a fairly significant obligation making the premises reasonably safe. An occupier is someone who is in possession of land or structures, or who has responsibility for and control over the condition of premises or who can enter the premises. This obligation requires, for instance, the reasonable removal of ice and snow, or the maintenance and repair of walkways. This same duty does not apply to trespassers or people who willingly accept risks - those situations are governed by another part of the OLA. Importantly, there is a 2-year limitation period to commence a claim for damages arising from a slip or trip and fall. Also, if you are injured on Crown land, you must give the Crown notice of the accident within 10 days of the event.
