It is said "Dogs are a man's (and a woman's!) best friend". However, that is not always the case. Unfortunately, sometimes dogs bite or attack. The legislation that applies to this situation is the Dog Owners' LiabilityAct. Under thisAct, dog owners are held strictly responsible for any injuries and damages arising from their dog's attack or bite. So you only need to show that you were injured as a result of the dog attack or bite and who is the owner of the offending dog. You can seek compensation for any injuries and damages you incurred. When awarding damages, the court will consider the extent of the injury, including any scarring, the need for future care, and any income loss or out-of-pocket expenses incurred. If the victim did something to cause or contribute to the attack or bite then the dog owner's responsibility may be reduced, and so may the amount of damages. Notably, a dog owner's homeowner's insurance policy usually responds to a claim for damages arising from a dog attack or bite, so a victim can usually be assured there is coverage for their damages. If you have suffered injury or damages as a result of a dog bite or attack, I am happy to meet you at our Georgetown office located at 8 Guelph Street in the Lounsbury Life & Group Insurance Benefits building to discuss it.
