Carnwath (retired) I start all my conversations about child support by telling my clients the Child Support Guidelines are "written in stone". There is very rarely room for negotiating a lower child support payment. First there is no requirement for the custodial parent to spend the support on the children. Child Support is dependent on the payor's income alone. Second child support can be lowered only in the rarest events where a successful claim is made for "Undue Hardship". To show undue hardship the payor must prove something unusual in his or her circumstances that makes paying Guideline support a greater burden on them, than other payors with similar income. This is only successful in rare circumstances which is why I start the conversation with the Guidelines being "written in stone".
