These are just some of the examples of the trauma endured over a 15-month pe- riod in which her common- law partner, identified in court documents as 25-year- old Anand Dindyal, assault- ed her repeatedly in attacks that included using a coffee mug and breakfast plate as weapons, and another inci- dent in which "he picked her up and threw her face-first into the couch," Superior Court Justice Michael Gib- son said in his ruling. "This is a domestic abuse case that involves a sustained pattern of vio- lence committed against an intimate partner," Gib- son said. Dindyal was convicted of six counts of assault, two counts of assault with a weapon, one count of ag- gravated assault, and one count of mischief in rela- tion to his common-law partner, and also of one count of assault in relation to her young son, now sev- en years of age. As a result of the as- saults, the woman has suf- fered "permanent and life- altering injuries," the judge said, adding the attacks took place between June 2016 and September 2017. Both Dindyal and the victim described their rela- tionship while together as "unhealthy," with frequent arguments and excessive drinking. "It is evident that during the relationship Anand Dindyal displayed frequent anger management issues, impulsiveness, aggression and violent behavior," the judge said. A victim impact state- ment read by the victim de- tailed the significant phys- ical, psychological and emotional impact that the assaults have had on her, as well as the "continuing ef- fects" upon her son. These include, the judge wrote, lingering and permanent pain issues as- sociated with the injury to her facial orbital bone, and on her self-confidence and ability to trust others and to enter into other re- lationships. Court heard Dindyal assaulted the young boy in August 2017 when he be- came fussy while getting a haircut at home. "Anand grabbed (child) by the hair, hoisted his pos- terior off the stool, and shaved down the middle of his head" and "nicked" his ear, the ruling states. The woman said her son was "terrified." Many of the assaults on the mother and son were committed in their home, in the area of Main Street South and Maple Avenue, "a location where they would have expected to feel the safest," Gibson added. Crown prosecutor Mi- chael Godinho wanted the judge to impose a jail sen- tence of more than five years, while defence law- yer Sweta Tejpal wanted a suspended sentence. The judge sent Dindyal to jail, but for "two years less a day," meaning the convicted man doesn't go to a federal prison. The judge said he need- ed to balance the prospects of rehabilitation along with deterring future inci- dents from occurring. "The evidence indicates that Mr. Dindyal lacked maturity and insight into how to appropriately be in an intimate domestic rela- tionship with another per- son," the judge said. "A penitentiary sentence is unlikely to make him a bet- ter person, or to foster the development of such in- sight. Specific deterrence is a very important consid- eration here."
