It is not surprising that separated spouses need money, and a good source of money is the net sale proceeds from the sale of the home. The net sale proceeds are routinely held pending an agreement of the spouses or court order. It is considered extraordinary relief to have any paid out in advance. For that to happen, you will want to be able to show at least several things: 1) you are suffering an economic disadvantage, 2) why you need the money, 3) paying money out to you now will help "level the playing field" in the proceeding, and/or 4) doing so will not jeopardize the other spouse's position at trial. Net sale proceeds from the closing of the sale of the family home is usually the best source of security to pay any money owing as a result of the breakdown in the marriage, including equalization of net family property, retroactive support and post-date of separation adjustments. So a spouse's security for those items should not be undermined.
