In a case where the couple is married and one of them dies without a Will, the surviving spouse is entitled to what is referred to as the "preferential share", after estate expenses are paid. If the spouse passed away before March 1, 2021, the preferential share is $200,000. If the spouse passed away on or after March 1, 2021, the preferential share is $350,000. If there are children of the deceased spouse, they will share any remainder with the surviving spouse. The entitlement for children includes adult children even if they have been estranged and had little or no contact with the deceased. The problem for common law spouses is that they are not included in the definition of "spouse" in the relevant legislation. This means that they do not benefit under the estate when there is no Will.
