surrogate courts in a case where over charging by a court official was suspected appeared in last issue of the waivloo chron- ilk and having reference to a subject of coufeiderable interest to the general public we give a place in our columns we pleased to be able to say however that as far as the surrogate court of our own county is concerned complaints of any kind are very infrequent and tbe officials in chargenjoy theruh confidence of the peo ple having business with them to ac ed tor of tie chrmidc dxxe sm acase of more than ordinary interest having arisen in connection with the fees charged by the register of the sur rogate court at stratford and as it would appear from the result of a recent govern mental investigation that fees in excess of the tariff fixed by laware also charged by the registrars of such courts in other countiei deem it right that the result of the investigation in i this case should be made pub-hc- j on the 17th of june last i transmitted the will papers duiyiprovedofonekessel of ifornington co perth lately deceased to the etostrar of the surrogate court at stratfordt asking for i statement of the fees required to probate tbe same and was in- formed by return mall that the sum ot 921 was required as the personality in this case only amounted to the sum of 9600 my knowledge of the charges usually made and the fact that this same officer had some time ago made an overcharge of several dollars in a similar cae transmitted by me i fell that the time had come when jin in vestigation into his manner of making charges should be maov before entering a formal complaint i wrote the registrar of another gnxuty asking what his charges would be on a short will where the person ality was coo and got his reply to send 1 1325 i then entered a formal complaint withthe provincial secretary who at once instructed the inspector of such offices to enquire into andjreportupon the charges made by tbe bistrar of the s cat strat ford and the provincial secretary has forwarded me tbe inspectors eeport which is as follows toboxto 9th july 18m sis i have the honour to inform you that pursuant to instructions i have en- quired into certain overcharges made by the registrar of the surrogate court of the count of perth in connection with his fees for proving the will of one kessel and beg to report as follows his fees as charged amount to the sum of 2115 and are made up as follows 1 application t 50 2 eeceivicg and entering certificate of surrogate clerk 10 3 preparing papers loo postage forwarding same to lin- wood 20 grant 250 three copies of will 300 probate under seal of court 50 notice of grant to bur clerk 25 drawing order for judge 10 attending judge for order 50 postage on betnsi 50 stamps 460 judges feei 760 atiou of these chargea informed me that he had been aooustonim to charging feet upon the value ji such real estate the tame a if it im pertonallty the judge of the county court of the county of perth at altoaeveralof the other county court judget holding that tuoh a devise convert ed the reality into personality and that they were therefore entitled to feet on it at such this ia u i informed the registrar contrary to the opinion of the honourable the attorney general upon the subject a copy of which i have forwarded to him u alto to the other surrogate registrars now under my jurisdiction with the intima tion that i would require these fees to be charged in accordance with such opinion these itemsnumbered 5 12 18 although correct under tbe diction of some of tho county court judge will therefore be re duced to ii 1150 and is respectively i have added 50c for a certificate required under the statue to be attached to the will by the registrar to which he is entitled thus making the correct fees amount in all to the sum of 11056 the registrar hat signified his willingness to accept this sum in full of all fees when tendered from this report it will be seen that this officer in this case demanded fees 100 per cent over the legal tariff it will alto be seen that such overcharges were not confined to this case similar charges having been systematically made and that too it would appear with tho approbation of the county judge if this system of overcharging was con fined to this one official and to one county the evilor grievance would not be so bad but from the statements made by him to the inspector and from the fact that the registrar ot another county demanded 11325 instead of 1066 or an excess of 9270 over the proper feet from me to probate such a will we are led to oonclude that this business ot overcharging by the registrars of our surrogate courts covert a much wider area than the county of perth and it is high time that the people should wake up
