al lowed recourse to appeal again rrora in our aaaeaament or what we may conaidar an imjust assess ment th amtnnt act require the aasmaor to make an asseastnent of our property each year and on the amount of thia assteasanent la cmlculatad the taxes which we will pay next year the assessor has no control over the tax rata wtjlch la rt by the local municipal council and their method u to divide the amount re quired to provide the municipal service for that year into the total taxable aaseeemenl and thus la de termined the mill rate which lit turn la applied against each taxable assessment as made by the local assessor so in other words if you do not appeal against an unjust as sessment you cannot sppcwl against the taxes set on this ivcumnii ft when the assrssor decides on the value to place on a property he in serts this amount in the assessment roll opposite a description of the property then a few days prior to handing the completed assessment roll over to the municipal clerk he forwards to each taxpayer and rate payer an assessment notice setting forth the amount of the assessment on his property the taxpayer or ratepayer if he feels that his assessment is too high or that his assessment is unequitable compared to other assessments in the municipality can appeal either his own assesvnent or any other ssnsamcnt in the municipality the period fof ajpcaling is stated on the notice and is ithln fourteen days after the roll i returned to the municipal clerk or in some munlci pelt ties within ten days appeal procedure however the correct procedure would be to fir it visit the assess or prior to entering your apcl and ascertain from him the reasons of your high or unjust assessment the wise assessor welcomes these inquiries and in fact invites them and opens his appraiaal cards for of which mora will ba mid later in another article l so that you can compare the assessment ftf similar property and his method of determining values if you are not satisfied with his explanation then you should enter your appeal in the court of revi sion which is composed of local cit- sens except where county courts af revision have been established the appeal must be delivered in writ ing either by mall or personally to the a commissioner if there be one or to the clerk of the municipality within the time limit j the court of revision hearings are quite informal and there is no charge to enter an appeal how ever your efforts should be con sidered wasted unleaa you arc in equitably assessed as assessments today arc being set at much below actual value and you cannot hon estly claim as a rule on overassess ment alone farther appeal possible now if the court of revision should rule that your assessment is fair but you are still not satis- fled your next step is to appeal to the county or district judge or the ontario municipal board however if you appeal from the court ot revisions decision direct to the on tario municipal board you have jest your opportunity of a further appeal to the judge your appeal to tho judge follows the same form as appeals to the court of revision and must be entered within ten days after the clerk has sent you by reg istered mail notification of the de cision of the court of revision there is also no charge for appeals lto the county judge if you are still not satisfied with the decision of the judge or you intend to appeal direct from the decision of the court of revision to the board you have twentyone days to appeal to the ontario muni cipal board this period dates from tho time of notification by the clerk and your notice of appeal must be sent by registered mall not only to the board but also a similar notice must be sent by registered mall to the municipality a fee 61 2500 for each property you appeal must ao company the notice to the board if you are successful in this appeal it is quite probable that- munl- dpelity will be ordered to refund you this amount for involved or tleriaiy eases the
