The ERT hearing was held after five residents who live near Halton Place appealed a Niagara Escarpment decision to issue permits for three events there-- the Summer's Here Horse Show already held in July, and the upcoming AAC National Championships (dog agility) August 16 to 18, and Canadian Country Classic (horse show) August 22 to 26, and August 29 to September 2. Hearing officer Knox Henry said he planned to work on his decision over the holiday weekend and "would be delighted" if it was released in 10 days. On Friday the participants summed up their arguments during the third and final day of the hearing. Jack Pemberton, one of the residents appealing the permits, said the Niagara Escarpment Commission (NEC) originally granted Halton Place a permit for a private equestrian facility and has never amended that permit to include commercial activities. "We are entitled to be protected by the relevant authorities to see that zoning bylaws are monitored and adhered to. In this instance this is not the case," said Pemberton. He said unlike when it was approved, today, Halton Place "is a large active commercial business." He said by permitting the dog agility trial and upcoming horse show the NEC acted contrary to the Niagara Development Act and asked the hearing officer to revoke the permits.
