Mattamy Homes representaâ€" tives were before planning and development council on Feb. 19th to request permission to set up a sales office at Upper Middle Road and Joshua Creek, the future site of a residential development. The developer‘s request was denied, however, because it would violate the town‘s zoning bylaw, said David Humm, the director of building services. "The zoning bylaw permits a sales office to be located on lands where construction is in progress or permitted," he said. "Staff have consistently interpreted this to mean that a sales trailer is permitâ€" ted â€" providing a building permit (for the trailer) has been issued â€" on land once it is registered." Humm said Mattamy wishes to open a sales office on land which is to be acquired by the town and used as a future fire station site. The land abuts the Bayshire subâ€" division. On Feb. 16th, Mattamy presiâ€" dent Peter Gilgan received a variâ€" ance from the committee of adjustment. However, Gilgan is required to wait out a 30â€"day The fashion shows run at 1:00 p.m. and 3:00 p.m. Admission is free but registration is required for seating and door prizes. Call 338â€"9402. The Glen Abbey Golf Club is playing host to The One of a Kind Bridal Show on Sun. March 7th featuring fashions by Dorâ€"Mel Salon and Tuxedo Royale. The show is designed to assist brides with the planning of their big day by offering displays from about 20 local weddingâ€"related businesses who will be on hand to answer questions. The appeal period is set to expire on March 18th. Had council approved Gilgan‘s request to open during the comâ€" mittee adjustment appeal period, a precedent would have been set, Humm said. "It would have meant anyone who had received a variance from the committee of adjustment could come back to council and say ‘Can we carry on?‘ It gets around the appeal period that allows citizens to come forward with their concerns," he said. If the town receives an objecâ€" tion to the zoning variance, there exists the possibility the matter could be referred to the Ontario Municipal Board. Humm said Gilgan applied for a building permit for the sales office last December. He was then informed no permit could be issued until the land was regisâ€" tered or committee of adjustment approval was obtained. Later the same month, Gilgan met with building services staff to inform them a sales trailer at West Oak Trails would be moved to the Upper Middle Road site. Gilgan was informed that movâ€" ing the trailer to the site without a building permit would be in vioâ€" lation of the Building Code Act, Humm said. One month after submitting a building permit application, the trailer was moved to the site. A building inspector was directed to monitor the placement and issue an order to comply if any activity was observed on the site, Humm said. Although the sales trailer has been moved to the site, Gilgan, in a written statement to the Oakville Beaver, said "we will not be able to be at this location, On Jan. 12th, "construction activity was observed and an order to comply was issued. Activity then ceased," the buildâ€" ing service director said. We think that the woodlot and open spaces together with the unusual topography will combine to make it a very pleasant environment for people considering a new home in east Oakville," Gilgan said in the statement. "It is because of these extraorâ€" dinary physical characteristics that we would like to have our sales facility located onâ€"site.
