See dealer for details. v # mm mm mm w In 1991 Raghbir Singh Dhaliwal and his wife Avtar Dhaliwal of 1103 Oakery Woods Place were charged with having two lion pillars encroachâ€" ing on town property. The Sikh couâ€" ple argued in Oakville‘s Provincial Offences Court the charges were disâ€" criminatory and violated the Charter of Rights and Freedoms. The Dhaliwals were originally convicted of the charges, but appealed the deciâ€" sion and were granted a new trial. Charges against the Dhaliwals were eventually "stayed" and the couple were awarded $100 in damages to be paid by the town. Despite the outcome, Carr said at the time he was "pleased" the ruling was based on the particular fact of the case, and that Justice of the Peace Carole Starr was not prepared to throw out the town‘s bylaws and enforcement policies. Oliver wondered whether the Town should simply repeal the bylaw since it can‘t seem to enforce it. The original court case and the subsequent appeal by the Dhaliwals lion pillars to remain were laden with testimony about racial harassment by neighbors. Starr said the town erred by following through on their complaints which, she said, were rooted in racism. Starr said there were also racial overtones to a letter from a real estate agent to the town, which stated property valâ€" ues in the Dhaliwals‘ neighborhood would go down as a result of the encroachment. All these factors combined "leave the town in a position of having known, or ought to have known racial discrimination was taking place. The town condoned the discrimination and continued its own discriminaâ€" tion," Starr said at the time of her decision. She said the Dhaliwals‘ situation isn‘t comparable to other bylaw infractions where the town has shown "discretion" in its enforcement. Starr said there was no evidence that there was any religious discrimiâ€" nation against the Sikh couple, despite evidence that lions are a Sikh religious symbol.
