Smokers may face further restrictions By BARB JOY Oakville Beaver Staff "~% mokers who light up in S Oakville‘s public places and at work may be further restricted after a Nov. 16th meeting at town hall to examine possible chan«es to the town‘s smoking byâ€"law. At the 7 p.m. meeting, the region‘s health department will preâ€" sent answers to questionnaires it cirâ€" culated to businesses and individuals over the past six months and petition opinions from those attending the meeting. The survey was in response to town council‘s request that the region conduct a "public consultaâ€" tion" to determine concerns and opinions Oakville residents have about the smoking issue in three areas: public places, the workplace and tobacco sales to minors. It is an attempt to revise the current Public Places byâ€"law and enact a byâ€"law to control smoking in workplaces which the town doesn‘t have as yet. "We have been commissioned as the agent to gather information for presentation to council," said Joyce See, a public health nurse who is also involved in the Tobacco Youth Prevention Program. Of 20,000 questionnaires sent out to the Oakville community, 1,100 were returned â€" a response See considered "fairly good" â€" and, of 450 sent to businesses, about 175 were filled out. Those sent to businesses asked if they currently allow smoking in the workplace and if they favored a municipal byâ€"law to further restrict or eliminate smokâ€" ing in their workplaces. Currently, Oakville‘s workplaces are governed by Bill 194, the provincial Smoking in the Workplace Act which states that 25% of an enclosed workspace can be set aside as a smoking area. Although the intent of the Bill is good, See described it as "somewhat limiting" and one requiring a sepaâ€" rate town byâ€"law. "Theoretically, it means that, if you had 20 desks in a room, five of them could be smokers‘ desks," she said. See said she had not gone through the replies to give a difiniâ€" tive answer on whether more busiâ€" nesses favored a municipal byâ€"law as opposed to those wanting to establish their own policies. However, See conceded that this also worked in reverse with smokers timid about approaching nonâ€"smokâ€" ing employers because of a perâ€" ceived rejection of their concerns. Questionnaires directed to the community included a paragraph relating to the health hazards of smoking and then outlined restricâ€" tions in the town‘s current Public Places byâ€"law. One section of the byâ€"law states that "no person shall smoke in an enclosed indoor area used as a theatre or other place of public assembly," although the proâ€" prietor can designate an area not to exceed 50% of the total floor area as a smoking area, complete with signs stating it is. The byâ€"law also states that restaurants may set aside 60% of the eating area as a smoking area which should be separate from the nonâ€" smoking area "provided, however, that a proprietor is not required ... to make structural alterations or to install barriers or partitions" to comâ€" ply with the byâ€"law. Although Oakville Trafalgar Memorial Hospital and other mediâ€" cal offices have established their own noâ€"smoking policies, See said there is currently no restriction in the Oakville byâ€"law on smoking in health care facilities such as hospiâ€" tals, nursing homes and medical offices. Nor are there any regarding child care facilities, bus/transit shelâ€" ters, laundromats, gas kiosks or places of amusement such as bingo parlours, bowling alleys, billiard halls and arcades. She mentioned a complaint to the mayor about an attendant in a gas kiosk who smoked, citing the enclosed smokeâ€"filled area as well as the combustibility factor of the product sold.
