At this point I think we should clarify exactly what is happenâ€" ing here. To understand the situation, there are two aspects to condominium living involved. One is the freedom you with a situation which seems to radicalâ€" ly change the appearance of your home. That this can happen in a condominium corporation is no more unusual than to suddenly find that the quiet street upon which you have lived for so many years has become a major thoroughfare due to the opening of a large shopping centre across the road. It sometimes sound like those condominiums in which the board of Directors fails to adequately communiâ€" cate with the unit owners. What you may have forgotten is that the hedge you so highly prize was grown on your exclusiveâ€"use common element. The only right given to you about this area is the right to use it for your pleasure. No other owner can usurp it â€" only you â€" but it still remains a common element and the Board has the right to enter, to repair, maintain or change it. The Condominium Act points out that the Board has an absolute duty, conferred on them by virtue of their office to govern the management of the property. (Sec. 24 â€" (1) (d). If the Board members do not discharge their responâ€" sibilities, they can be required to do so because the act says the Act, the declaâ€" ration, byâ€"laws and rules must be obeyed. From your account, it would seem that your Board of Directors has underâ€" taken a program of either repair or maintenance of the fences in your comâ€" plex, and as a result have gone ahead and removed a portion of your hedge. This it has the right to do, although, as a matter of courtesy, they should have informed you of their plan. Unfortunately there is little you can do beyond requesting an opportunity to meet with the Board before it proceeds with any further destruction of your hedge. I would recommend that you write a letter asking for the opportunity to discuss the matter with them before any action is taken, if such is required, and to have them consider any alternaâ€" tive steps that might be adopted in this repair program. As is so often the case, lack of comâ€" munication between Boards and unit owners leads to unnecessary confrontaâ€" tions, hot tempers and bad feeling which can sadly disrupt the even tenor of life in that corporation.
