3e As far as the public is concerned, the justice system has failed to protect their interâ€" ests. While defense lawyers and homosexual rights activists may cheer Judge Latimer‘s decision, we see nothing to rejoice about. The public has the right to expect protection from this type of activity in a public washroom. yet rather than ensuring this protection is possible, the court system has once again all_owed_tpe accused to escape prosecution on a legal technicality. All of these are reasonable expectations, yet on the surface it would appear the courts are more concemned with protecting the rights of the accused then of the general public. No one can deny illegal and offensive acts were being conducted in the Shell Park washroom. No one can deny it had become such a nuisance that parents were afraid to have their children in the park. In his decision, Judge Latimer ruled people using the washroom had a "reasonable expectation of privacy." However, should that "reasonable expectation" of privacy also not pertain to other nonâ€"homosexual users of the washrooms. Should we have the "reaâ€" sonable expectation" to use the washrooms without being propositioned to perform a sexual act the majority of the public finds distasteful. Should parents not have the "reaâ€" sonable expectation" to send their children into a public washroom without fearing they will be exposed to something which could detrimentally affect them for the rest of their lives. Taxpayers should have the "reasonable expectation" to be able to use a public park their taxes have paid for. In a nutshell, when the police installed the cameras, they did not require a search warrant from a judge. However, changes to the Criminal Code, which would have required them to do so, had already been passed by parliament, but had not yet come into effect. Latimer ruled the police should have been aware of the pending changes when they installed the cameras. â€" to a layman, Judge Douglas Latimer‘s recent ruling regarding the use of video cameras to monitor homosexual activity in the Shell Park washroom doesn‘t make much sense. Charges of indecent acts against five men arrested a year ago were stayed by the judge after he determined the cameras were an invasion of privacy and had infringed Section 8 of the Charter of Rights and Freedoms. His decision appears to centre around the timing of legislation regarding the use of video tape surveillance cameras by the police and the actual installation of the cameras by the police. We need leadership at the Region; we already bhave it at council with councilor Smith and I‘d like to thank councilor Smith for listening to the majority of the people on this issue. The important issue is not that of the Grand Blvd. plaza, it is that of bad representation through attendance and actions, so please don‘t try to cloud the issue by dwelling on the plaza issue.
