The Oakville Beaver, Friday June 2, 2006 - 9 New law Model air show replaces patchwork Continued from page 1 go," he says. "The only places that will probably hurt now are the border towns." "I don't see this as being a longterm drop (in business)," adds Costello, who suspects a clean-smelling, smokefree bingo may attract new, non-smoking patrons. The provincial legislation, which came into effect on May 31, bans smoking in all workplaces and enclosed public places which are not primarily places of residence. The province is promoting the legislation as a replacement for a patchwork of municipal bylaws that allow different standards in communities. Those differing standards were the main complaint restaurant and bar owners in Oakville had when the town's legislation took effect in May 2002. At that time, there were fewer smoking prohibitions in some nearby communities. Even while passing the Oakville bylaw, local politicians were calling on the provincial government to bring in legislation to ensure a level playing field between municipalities. However, in the ensuing four years, most nearby municipalities have since enacted their similar own anti-smoking bylaws. For restaurants and bars, the main impact of the new legislation will be to prohibit smoking on covered outdoor patios. Smoking will still be allowed on uncovered patio areas. While Bronte-area restaurants were among the most vocal opponents to the Oakville bylaw when it was approved, Bronte BIA executive director Liz Behrens says she hasn't received any calls of concern about the new provincial legislation. Although the impact may not be felt strongly in the hospitality sector, Paul Burgher expects there will be some transition pains in the manufacturing sector. As supervisor of the Halton Regional Health Department's tobacco control division, Burgher will oversee enforcement of the provincial legislation. He notes that the legislation specifically prohibits smoking in all workplaces, and that includes garages and factories where smoking has been traditionally overlooked. The legislation also impacts tobacco retailers, who will be required to eliminate countertop cigarette displays and undertake stricter measures to ensure tobacco is sold only to people 19 years or older. Burgher says fact sheets have been mailed out to all tobacco retailers to outline their obligations under the new legislation, and that that public health and tobacco inspectors will be visiting gas stations and retailers to ensure they are complying. Information on the provincial legislation is available on the regional website (www.halton.ca under the tobacco section.
