Mulvale even tipped her hat to the OMB -- though she said she is not letting up on the lobby to reform it -- which she said pushed hard for the parties to resolve issues outside of a hearing. Negotiation with landowners not on board with the settlement continues, but it's hoped this deal will give greater clout to those efforts. "We believe that the position, unanimously endorsed by council will bring others to the table," said Mulvale. Lyons and the mayor noted strength was gained toward settlement as the province took part and then stood tough with the Town in both the north Oakville planning process and negotiations. "Without the province standing squarely with the Town of Oakville, we doubt we could have done this. It puts the Town in a strong position as it continues to negotiate with other landowners in north Oakville," said Mulvale. Green space and balance of parkland, residential and employment land were "nonnegotiables," said Mulvale. With the NHS solidly footed in science -- with everyone from water chemists and hydrogeologists, to biologists and migratory bird and fish habitat experts having created numerous plans including the SubWatershed Study -- it proved a formidable foe for the development community to defend against at a hearing. That was particularly so as the Town had formed what Lyons called "a strong alliance" on it with the Province, Halton Region and Conservation Authority. Though the OMB challenge had put the developers, rather than town's NOSP before the OMB, this settlement puts the Town's NOSP back before the OMB. According to that, North Oakville, which will be planned in the New Urbanist style of more compact communities, "We're getting a new framework for every greenfield development and it will be a benchmark against which others are measured." Oakville Mayor Ann Mulvale will have a higher jobs/residents ratio aimed to foster live/work scenarios that will reduce commuting and promote transitfriendly, cycling-friendly communities. Mulvale said NOSP is on the leading edge and is lock step with the province's Places to Grow expected to be made official today. "We're getting a new framework for every greenfield development and it will be a benchmark against which others are measured," said Mulvale, noting Oakville is a small town in the GTA, but is "leading the way" thanks to the collective community. "We welcome other landowners to come to the table," said Mulvale, noting it's better for the developers to get on board than to fight the community. Time is money for the developers, and that was part of the clout the Town brought to bear. That may now even gain strength as the agreement has fragmented the North Oakville Management Inc. (NOMI), the collective group of landowner/developers that had challenged the Town for taking too long to devise its NOSP and headed to the OMB. It means greater legal costs will be incurred by those outstanding to the agreement as there are now fewer of them to pay the bill. Oakville wasn't going to be rushed by the developers, said Mulvale, nor will it give up the employment side of the equation that will cut down commuting and bring higher property taxes than residential taxes to the town to pay for more services. The NHS is also leading edge as, for as Lyons explained it, it doesn't just save a woodlot because birds may live in it, but also preserves the nearby meadows in which those birds feed, or streams in which amphibians breed while they live on land. Much credit was given to the province as it worked with the town on what's been called the InterAgency Review (IAR). Instead of offering comment after the fact, it participated in the process. "Parts of the new Provincial Policy Statements (PPS) come as a result of work they did with us," said Cheatley, who was keeping a low profile as he will be a Town witness at the August hearing. It was also the Province that got things back on track when a shortfall was created in the planned employment land when the Province announced it would preserve 750 acres of the 1,115 acres owned by the Ontario Realty Corporation (ORC) and which are north of Dundas and west of Sixteen Mile Creek. "We hit a roadblock. That was a deal-breaker for us," said Mulvale, noting the Town had refused to willingly build an even denser community in order to make up the shortfall. That shortfall, 100 acres, was however reportedly compensated for as the province agreed to the Town taking 100 acres of land in the protected area to be used as parkland, including active parkland, in exchange for rejigging employment and residential communities. The settlement was reached with about a dozen landowners, while approximately eight others have not settled. The town is also working separately with some individual resident landowners.
