LET THE OAKVILLE BEAVER HELP YOU WITH YOUR The Ontario Municipal Board (OMB) has turned down the Town of Oakville's request for a review of the OMB decision affecting the former Shell House property. Lawyers for both Palm Place Developments and the Town, Jane Pepino of Aird & Berlis, recently received a letter to that effect dated Nov. 7 from OMB chair Marie Hubbard. The former Shell House property that sits on Lake Ontario in Oakville's west end, was the subject of a protracted OMB hearing. A decision announced last May, saw the OMB approve the east half of the property to be conveyed from the developer, Palm Place Developments, to the Town of Oakville at no cost for use as a public park. The decision also approved the construction by Palm Place of three five-toeight storey, terraced buildings on the west half of the property. The decision left the door open for Town Council to purchase the entire property for use as a public park, but the cost proved prohibitive. In the end, the Town settled to take half the property as a park, but asked for a review of the OMB hearing. "I will not direct a motion hearing for review," states the letter from Hubbard. After listing numerous reviews made of information in the case, Hubbard stated, "I have concluded there were no errors of fact or law made by the panel. I find that there was no material misunderstanding of the facts found by Members (Norman) Jackson and (Gary) O'Connor. After reviewing their decision, I have concluded that the members made findings of fact where necessary after hearing submissions regarding various and sometimescontradictory facts. I have also concluded that members Jackson and O'Connor did not make any material errors of law and that there is a foundation for the conclusions reached by the members." Hubbard concluded, "I will, therefore, not direct a motion for review and the decision will remain in full force and effect." The OMB released its decision on the former Shell House property May 18. Afterward, the Town, through its legal counsel, Pepino, made a request for a motion hearing to be established to consider a review of the decision. Ward 1 Councillor Ralph Robinson has said he is pursuing a call for a public inquiry into the Palm Place matter. Though a public inquiry is not possible through legal mechanisms in place, Robinson said he will turn to Ontario's Ombudsman. Shopping!
