On July 19, 2005, the worker was moving plywood on the second floor of a partially-built home, located on Kent Avenue, when he slipped and fell, crashing through a covered opening on the main floor to the basement below. The worker suffered broken bones, bruised lungs and a concussion. A Ministry of Labour investigation that followed found that the second floor did not have any guardrails around the perimeter as required by Section 26.3(1) of the Regulations for Construction Projects. The president of Alto Mar, the construction company hired by the home's owner to supervise the demolition and reconstruction of the house, pleaded guilty to a violation of the Occupational Health and Safety Act, receiving the fine Feb. 26. In addition, the court imposed a 25 per cent victim surcharge, as required by the Provincial Offences Act. The surcharge is paid to a special provincial government fund to assist victims of crime.
