Unlike all the other witnesses, this teen, who admitted he was drunk, insisted the second fight took place near the garage, with Hildebrand falling over a bush and landing on his back on a concrete patio. Other Crown witnesses testified the second fight occurred at the edge of the driveway where Hildebrand struck the back of his head. The teen said he and the accused were already drunk when they arrived at the party. By the time they left, each had consumed at least nine beers and several liquor shooters. Hildebrand also made fun of the accused and was laughing at him on the way to the party and got into an argument with him during the event, the teen said. Hildebrand's mother testified earlier today that her son never told her that he hurt his head in a fight. She only discovered what happened when she spoke to her son's girlfriend after he lapsed into a coma. Crystal Simmons said her son maintained right up until he became unconscious that he hit his head when he tripped over somebody's foot. "He was always very vague," she said. She thought he might be suffering from the stomach flu when she found him vomiting in a bathroom sink about 5 a.m. on March 30. "He hadn't slept, and had been sick all night," she said. He went back to bed but got sick again about 7 a.m. Simmons brought him a glass of water and a Gravol tablet but he Drew Hildebrand knocked it over when he reached for it while lying in his bed. "It was like his hand didn't open," she said. She made him a bed on the couch later that morning. "He came down in underwear. I was shocked. I hadn't seen him in underwear for many years. It was strange," she said. Simmons asked if he drank too much the night before. He said he only had a couple of drinks. He maintained he hit his head in a fall, she said. "He tripped and fell over somebody's foot and had fallen backwards and hit his head on concrete," she said. "I thought he had a concussion. The pain in his head was a two on a scale of 10." Simmons pressed him further but he insisted he "just fell over somebody's foot. "He was being vague. He was very pale, tired, and lethargic," she said. Simmons took him to a walk-in clinic. He was examined and advised to get a CT scan at Oakville Trafalgar Hospital. At the hospital, he again never told anybody about the fight. He said he tripped and fell back and hit his head on pavement. He vomited several times. He'd been dizzy. His eyes had been blurry but he never lost consciousness. His ears were ringing. He had a headache. Doctors told her following x-rays that her son's skull was fractured and there was bleeding on his brain. "In the waiting room he was very tired and (his speech was) very slow," she said. He was transferred by ambulance to the Hospital for Sick Children about two hours later. Once there, he suddenly rolled over in a bed and grabbed his head. "...his head was really hurting...it was now an eight," Simmons said. "His words kept getting slower and more garbled. "He looked at me and said 'tired' and went unconscious." He underwent surgery but remained in a coma. The following day her son's girlfriend told her about the fight. "He had been assaulted and pushed to the ground," Simmons said. "My ex-husband then went to police." The accused youth, whom many Crown witnesses also say was drunk and angry, didn't produce a weapon although he boasted having a knife before he pushed Hildebrand, jurors heard previously. No punches were ever thrown during the brief pushing match, court heard. There was also no history of bad blood between them before that night. Police said the man was in a condominium complex at 1542 Lancaster Dr. at 6:45 p.m. when a group of six youths walked passed him. "They stopped and one kid returns and he points this pellet gun at the complainant," said Sgt. Brian Carr, Halton police public affairs officer. The teens departed moments after the display, but were soon found by police along with the pellet gun. The 17-year-old who allegedly pointed the gun has been charged with possessing a weapon for dangerous purposes. Police note robbery was not the motivation for the act, but rather the youth was `being an idiot.'
