On this basis, it is recommended that the application be refused." Town staff also voiced concerns in the report about the effect shadows cast by the eight-storey building would have on the surrounding area. The developer did nothing to ease these concerns. According to the report, a shadow study was not turned over to Town staff as requested. Town staff also had problems with the application because, in addition to requesting a larger than permitted building, the developer was also requesting smaller parking facilities than normally allowed. Town staff also took issue with the fact that a 120-square-metre section of the property the developer proposes to build on is actually owned by the Town. In order to proceed under the current design, Town staff noted, the developer would have to acquire the land from the Town. "To date, the developer has not approached the Town regarding the potential purchase of this parcel of land," said Capper. Area residents were similarly unimpressed by the development, with multiple speakers coming forward at the meeting to attack it. "The proposal is absolutely not in scale with the area and eight-storeys is more than double the current zoning height limit and exactly double the new official plan limit," said Laurie McGinn of the Bronte Village Residents' Association. "As we are just letting the ink dry on our new Official Plan and after so many public meetings and consultations to determine appropriate building height for Lakeshore Road, this proposal would fly in the face of all the work that has been done." McGinn said parking is already an issue in Bronte without the introduction of a development that may not contain adequate parking facilities. Jane Kennedy, who lives across the street from the proposed development also voiced concerns about its size and the addition traffic it would bring to the area. "It would have a very overpowering impact on all those townhouses and I am concerned about the value of our property," said Kennedy. Former councillor Mike Lansdown noted the developer had put so little effort into creating a development that was compatible with the community that the application should be considered frivolous and without merit. The developer has appealed its case to the Ontario Municipal Board.
