The developer, 394 Lakeshore Oakville Holdings Inc., had called for a zoning change to the area, located on the south side of Lakeshore Road West, east of Birch Hill Lane and west of Shorewood Place in the Old Oakville Community, that would have allowed for reduced front-yard setbacks, changes to the rear-yard setbacks, increased building heights for some of the units and the deeming of a private road to a public road for zoning purposes. Area residents and Town staff have raised numerous concerns about the proposed development, including the issues of tree preservation, servicing, transportation, shoreline protection, heritage and cultural landscape preservation and lack of compatibility with the character of the community. The site also has a 1930s lakefront estate on it called the Lambert-Smye house, which the Town wants to designate under the Ontario Heritage Act. The developer does not want to remove the house from the area, but rather incorporate it into the condominium design. In the end, council voted against the development plan with Town staff stating in their report that the development was not well planned and is an overdevelopment of the subject lands. Town staff also stated the proposed development does not conform to the established character of the neighbourhood; does not conform to the policies of Oakville's existing official plan; does not conform to the policies of Livable Oakville; cannot be adequately serviced; does not have sufficient access; does not maximize tree preservation or provide justified shoreline setbacks; does not provide preservation of heritage features and cultural landscape.
