is to be heard by a county court judge instead of the Police Com mission The decision to have a judge hear the appeal came after the Regional Police Commission learned an appeal is being launched at the commissions meeting at Thursday Brampton Lawyer John Greenwood who represents Sgt Jason Field told the commission that an appeal has been filed Field was convicted of unnecessary violence under the Police Act on December The case heard before Police Chief Skerrett was in connection with the slapping of 20yearold Gary Sparling in Georgetown last May The reasons given for the appeal sparked a sharp ex change of words between Greenwood and William a Judge who also sits on the commission The judge said he resented the insinuations made by Greenwood in the appeal I don t believe it he told the lawyer the commission and the press Greenwood replied he was not Interested in the judges beliefs After another com from the lawyer said I dont think your opinion is worth a damn Under the notice of appeal Greenwood stated the original charge of October 18 purported to charge the sergeant with a criminal offence The chief had no jurisdiction and he should have referred the matter to the provincial criminal court the notice states The December amend to the original charge amounts to a new charge and it falls outside the six month statute of limitations Also in the grounds for appeal is the charge thai Chief Skerrett was properly motivated by a desire to convict the sergeant while the weight of the evidence showed Sgt Field was innocent of the offence Bias was exhibited by the police chief states the notice in Skerrett admission that the complainant and his main witness were lying with respect to relevant facts Skerrett concluded he would convict the sergeant because the youths could not be lying all the time the notice states Also contends Greenwood the chief showed anxiety because of complaints of a lawyer or lawyers in the community with respect to police brutality Another grounds for appeal used in the notice states the hearing proceeded in the apparent position that the onus was on the sergeant to prove his Innocence Greenwood also contends the chief should have disqualified himself from taking part in the hearing because of his alleged bias Police commission chairman William said Ihc board has not met formally lo decide how to proceed with the sergeants case However he told Greenwood it is likely the board will seek to it heard by a county court judge Sergeant Field was at the meeting dressed in a suit Field will apparently remain a sergeant until all the appeals process is exhausted Then If the chiefs decision that Field is guilty is upheld Field will be demoted to the rank of a first class constable If the yearold Field is demoted the cut in pay could amount to approximately by the time he retires at age 60 presuming his rank stays at that level said three or four members of the police commission had prior knowledge of the case before hearing so it is likely the appeal will go before a county court judge Greenwood said the disposition of the case was very fair The appeal will likely be heard in the new year Green wood said In an
