public works committee last week William Me nary whose Brentford contracting comp any holds the contract for operations the site said a settlement has been ar rived at with David Lawrence owner of the comprehensive ion bylaw for the former Township of area to provide for those Items In by law 74 51 which were not finally determined by the Ontario Municipal Board at the Hearing held on the comprehensive zoning by law commencing the 15th day of March At the time of the Ontario Municipal Board Hearing In March of 1976 a number representations were made by or on behalf of various in dividuals owning properties that would be affected by bylaw 7451 Most of the comments received by objectors related to specific properties where for Instance a commercial use had been carried out on the properly for a number of years prior to the date of the passing of the comprehensive zoning by law but through an oversight the land had been designated Rural or some other zone classification on the land use schedule In the decision of the Ontario Municipal Board dated the day April 1976 on the comprehensive zoning bylaw the approval or rejection of those parts of the bylaw where land had been Inadvertently designated other than the existing use was simply delayed to be covered In an amending bylaw Bylaw 7695 and In particular sections 14 18 20 22 and deal with specific properties where a zone change from the original designation In bylaw was deemed necessary Sections and 19 In Bylaw 7695 redesignate parcels of land shown on Schedule to bylaw from Niagara Escarpment E zone to Rural RU zone since after bylaw was passed by Council but before the Ontario Municipal Board Hearing In March of 1976 the new Niagara Escarpment Development Control Area was defined and at that time It was determined that these particular parcels of land did not fall within the Development Control Area Another maor area of bylaw was not covered In the original Board decision of April 5th and relates fo the and OS2 zones These zones are known as open space and hazard lands With the new mapping available from the Ministry of Natural Resources the original zones as shown on bylaw 7451 were deleted and the zones as outlined on Schedules B and E to Bylaw 7695 are to be substituted as outlined In Section Section 6 to by law deals with lands owned by Upper Canada College and known as Lots 14 and 15 In Concession 11 for the former Township of and provides that these lands may be used tor the uses historically carried out on the properties by Upper Canada College Sections 1 to Bylaw deal with general amendments to bylaw 51 In some Instances errors that were originally made In bylaw 7451 are corrected and In others general amendments to the bylaw are made In accordance with portions of the decision of the Ontario Municipal Board on bylaw on the day of April The Notice of Hearing published with this Explanatory Note sets out the time place and date when the Ontario Municipal Board
