its landholdings south of Silver Creek for many years Now that the matter is before the Ontario Municipal Board and the Supreme Court of Ontario the time has come to acquaint the residents with the facts so that our Companys position is clearly placed before you and relying on your basic fairness we enlist your support We have been a corporate citizen of Halton Hills since January when we acquired the entire holdings of Delrex Developments Limited Since that time we have been responsible for providing homes for a substantial portion of Georgetown while at the same time encouraging industrial development as well as expanding the Georgetown Market Commercial Complex Also we donated your water tower site and made church and school lands available below our cost Before we acquired the holdings we appeared before your Council and explained our Intentions fully and the Council unanimously passed a Bylaw consenting to the transfer of Development Agreement 198 from Delrex to ourselves thereby protecting and preserving the contractual rights and obligations therein contained This then is the crux of the Issue before the Ontario Municipal Board and the Courts Namely can one contracting party receive his benefits under a contract and then deny the other side his The major benefit to the municipality was the option to acquire acres of fullyserviced Industrial lands at 100 per acre being only a fraction of their cost let alone their worth The municipality acquired acres from us in having previously quit claimed its option on the remainder on the basis of approved sales by to General Flreproofing and Economy Forms The Town had bargained for and received an outstanding opportunity to build Georgetowns Industrial assessment base with its attendant benefit to residential taxpayers The benefit to our Company was the clear contractual right to register its lands south of Silver Creek Ttie following is an excerpt from Agreement 198 Paragraph 1c of Schedule D That at such time as the vendor McLaughlin shall desire to register a plan or plans of subdivision for the said Cleave farm and the Hepburn farm and the Wright farm It shall enter into a subdivision servicing agreement or agreements with the purchaser Georgetown and the plan or plans of subdivision and the site plan or plans shall be approved by the purchaser Georgetown and such other public authorities of the Province of Ontario as at that time may be required No one will argue that the wording couldnt be improved but the intent Is crystal clear Ie our contractual right to proceed with the development of the farms as subdivisions which were acquired on the basis that they would be an nexed After having annexed the farms in question and changed their official plan designation from Agricultural to Residential the Town has consistently refused to complete the balance of Its obligation by routinely implementing the Official Plan Amendment with a Zoning By law and entering Into a standard engineering agreement While we stood waiting emptyhanded your Council permitted registration of other Plans of Subdivision within the municipality none of which had our Companys contractual right The children who were enrolled In Grade 1 In January will be entering university next year an still we wait Without coming to any conclusions on municipal morality or good faith it must be apparent to the reader that this gross Injustice can no longer by tolerated by the Company There isof course Issue here and that Is the right of all citizens to affordable accommodation and the rights of their children to live in a neigh bourhood of their choosing at prices not arbitrarily increased by artificial shortages of housing forced on the citizenry by the political process Georgetown is a beautiful town In which to live and we pride ourselves in the quality of development which we have brought to this area On the other hand no one can sensibly allege that the Town would or should stay the same size with the same amenities It had at the beginning of this century GO Train service Is now available shopping centre facilities exist the sewage treatment plant has been expanded and the school system is second to none in the Province If the socalled concept of population pollution had been enforced In over onehalf of the population of the Town would not now be living in and en joying the amenities of Georgetown today Our Company has no intention of building a high density development but we do intend to add much to the quality of living in Halton Hills The vast majority of the proposed homes would be single family and semidetached and there is only a small number of street proposed which were felt to be essential In order to provide the desired mix of housing for a residential community such as Georgetown The only alternative to development on the south side of Silver Creek is highdensity infilling within the already builtup area of the Town of Halton Hills The ramifications of such a policy are probably not understood by the majority of citizens and will probably only be comprehended after being built and the resultant problems becomeevident The Company by
