principle anywhere along the Niagara Escarpment the Niagara Escarpment Commis NEC decided Thursday in Georgetown That means companies wanting to establish a landfill or enlarge an existing landfill along the escarp ment must now apply for amend to the Niagara Escarpment Plan Before Thursdays ruling the NEP permitted land fill sites in in virtually all basic designations of the plan ex urban minor urban and escarpment recreation areas ac cording to a NEC staff report John Minns a spokesman for Protect Our Water Environmental Resources POWER said now the NEC will first have to decide if a landfill proposal is a suitable type of land use on the escarpment instead of first assuming the land fill is suitable and then in ve tigating whether that is true Both Mr Minns and local Walt Elliot said the decision means the Reclamations Systems In corporated s RSI proposal for a dump on the escarpment in Acton is more than ever likely to fail The proposed Acton landfill site is located at Sideroad 22 and the Third Line RSI has to have serious con about whether they will be successful obtaining approval from the province Ministry of Environment to establish the Ac ton dump especially considering the problems found by the MOE concerning the proponent technical reports on the landfill s viability said Mr Elliot The RSI proposal is currently be ing reviewed by the Ministry of the Environment Once the review is completed the ministry will hold a public hearing That s not ex pected to happen until late this year or early Mr Elliot called the NEC deci sion the final victory in ensuring the escarpment protection in his riding The other two victories in elude the withdrawal of a proposal by Aggregate to make it s quarry in the southern part of Halton Hills a landfill and Ontario Hydros decision not to dump fly ash in the same quarry The way has been paved to rehabilitate existing quarries along the escarpment in ways com with tourism he predicted Mr Minns said the decision will make RSI think twice about its pro posal and whether the proposed land use is appropriate Calling the decision a milestone Mr Minns explained POWER now has a tool to scrutinize the RSI proposal RSI in a report submitted to the NEC argued the decision would lead to a multiple of ad and tax the commis sion time and resources and the patience of the public As well the province existing En vironmental Assessment Act and Environmental Protection Act en sure that the Escarpment isn t im properly used RSI also questioned the rationale used by the NEC planning staff in recommending to
