When asked about the Town of Oakville's power to prevent cell towers from being built on residential property Senior Planning Services Director Dana Anderson said such regulatory power does not rest with the Town. "We have no jurisdiction. If one of the proponents went to Industry Canada with a proposal to put a cell tower, under 15 metres, anywhere in the town, it's exempt. So there is no protocol, no consultation, we have no involvement," she said. "If the tower is over 15 metres it would trigger the (Town's Radiocommunications Facilities) protocol and right now the Town's protocol says that if the tower is within 200 metres of a residential area, we would not issue a letter (of concurrence)." Anderson went on to say that all the Town can do is make a comment on how it feels about the cell tower location. The federal government, specifically Industry Canada, makes the decision on whether a cell tower is allowed in someone's backyard. "There is nothing we can do to stop them," said Anderson. "Even with the current protocol, if someone were to come in right now and try to build a cell tower in someone's backyard, we would just say we're not providing any comments or design review, but they could still obtain that licence. It's so frustrating because I think the public's perception is that we have some role in regulation in terms of setbacks, and we don't." When asked if it would permit the building of cell towers on residential properties, what restrictions there would be and how common the practice of telecommunication companies paying residential property owners to build cell towers on their properties is, Industry Canada did not deny a cell tower could be built on a residential property. "Industry Canada has antenna siting procedures in place that require a tower proponent to consult with the municipality and public, as required, before installing the antenna tower regardless of its height or location," said Michel Cimpaye, media relations, Industry Canada. "Certain installations, including towers less than 15 metres, generally have minimal local impact and so may be excluded from municipal and public consultation, but should consider local surroundings. All installations are required to respect Health Canada's Safety Code 6 to ensure the safety of Canadians. Each service provider may have their own practices when selecting sites for new cell towers, however, all must respect Industry Canada's antenna siting procedures." A meeting on the Town's Radiocommunications Facility Protocol will take place Monday, May 14 at 7 p.m., at Town Hall, 1225 Trafalgar Rd.
