He did say Industry Canada would not support a 200-metre setback and that the Town does not have the right to block a cell tower installation. The resident delegations heard these remarks loud and clear. "It is very clear Industry Canada doesn't support any separation distances, so I would submit we keep the 200-metre (setback) we have," said Frank Clegg, chair of Citizens for Clean Air (C4CA). "The precautionary principle says that if we don't know, let's stop, slow down and think. There is nothing wrong with thinking and keeping what we have in place." Resident Jim Goodfellow also called for the 200-metre setback to be adopted, stating he saw no justification in going with a smaller setback, which could put people's health at risk, simply to make things easier for cell companies. When asked by Ward 6 Town Councillor Max Khan what the goal would be, as the 200-metre setback would probably just be overruled by Industry Canada, Goodfellow said it would lead by example and help get municipalities a greater voice in cell-tower siting. "This is a big issue, it's an important issue. Don't bail out. It would be so easy to say, `We've got no power, no influence, no nothing.' Don't bail out," said Goodfellow. Burton voiced concern that a separation distance may not provide residents with protection but regulations restricting cell tower signal intensity may be what really matters. One delegation suggested 1,000 microwatts per metre squared be the standard set. Wendy Perkins of the My Bronte residents' association said a combination of distance and signal intensity limitations are needed. In a written submission, Oakville MP Terence Young said he supports the 200-metre separation distance and plans to introduce a Private Member's Bill or motion onto the Order Paper of Parliament in an effort to get municipalities a greater say in where cell towers are located. Young also said it was important for the Town to act on this issue and not point the finger at the federal government. "There are two highly relevant precedents where towns and cities in Ontario led the way for upper levels of government on matters related to human health. The first was pesticides where the Town of Hudson, Québec went to the Supreme Court of Canada to claim the local power to ban them and won. This opened the door for every town and city to do so," wrote Young. "The second was smoking in restaurants, where GTA municipalities, including Oakville under the leadership of former Mayor Ann Mulvale, adopted a gold standard bylaw that made it easy for the Province of Ontario to later ban smoking in public places. These two examples prove that municipalities can determine public policy on health issues when they take a stand." Those who spoke, Tuesday, expressed doubt with claims made by Health Canada officials during the Monday meeting that Safety Code 6 safely regulates the amount of radiofrequency (RF) radiation coming from cell towers.
