Through the treatment court, individuals will be directed to appropriate treatment programs, which can be monitored and adjusted as necessary. The recommendations to treatment programs can be made by lawyers (duty counsel and private bar), police, probation officers, doctors, care providers and other individuals, such as the family members of the accused or the victim. Flynn applauds this move, he said, as often crime is driven by a mental illness. "It may be somebody that may not have been taking the right medication, may not have been taking any medication at all," Flynn said. "It may have been somebody who went through a first episode of a mental illness and didn't know what to do and panicked and maybe ended up hitting somebody." Too often, Flynn said, stories are told about a person who is put in jail when they don't belong there. "Then we're surprised when we see them back again six months after they get out. But, they haven't had any treatment for the mental illness," Flynn said. The courts already implement a diversion system that allows a judge or crown to order an individual to get some form of mental health treatment. However, the new treatment court goes beyond that. It functions with some autonomy from the regular system and has an added component of finding individuals treatment for addiction issues. Flynn said Halton is helping to pave the way as it is among the first jurisdictions in Ontario to offer such a treatment court system.
