Councillors have said the existing language of the arrangement could allow the introduction of slot machines and Video Lottery Terminals (VLTs) without the municipality's input. Changing exit clauses, which currently bind the Town to a 16-year contact while the OLG has a 90-day exit clause, was another condition. Dealing with issues surrounding cost-recovery and appropriate reciprocity were other conditions cited by the Town. The cost-recovery issues include forecasts by the OLG showing that, under the agreement, the Town will receive less money despite an overall increase in revenue to Oakville Delta Bingo. The reciprocity issues included a liability clause that the Town would assume full operational liability for Oakville Delta Bingo. Town staff met with OLG representatives on June 21, at which time the OLG confirmed it would not meet any of these conditions. During an April meeting Ron Ko, OLG Bingo gaming director, explained why the Town is not given a say in the agreement about what gaming systems it will receive. "The OLG has an obligation to the Criminal Code of Canada. The Criminal Code of Canada says only an agency of the Province can run gaming and that agency must control products, control payouts, control game design, control price," said Ko. "For us to put language in the contract that conflicts, that says `I am non-compliant with a law'." Delays in getting approval for the OLG agree- Johnstone said the OLG agreement is about modernizing Ontario's bingo halls and he has no interest in bringing slot machines into his business. He also said, he would not be the one who would suffer if the agreement was not signed. "I will survive. I do have six other bingo halls. The 40 staff that I employ will not, the 80 people I intend to employ at the end of this initiative will not, the 34 charities that we represent will not." Until a decision is made and in the interest of these local charities, council has directed Town staff to work with Delta Bingo to enhance its external communications as a reminder to the public that the local bingo hall is still open for business.
