Town council voted recently to approve a motion brought forward by Ward 1 Councillors Ralph Robinson and Alan Johnston, which called for offers to purchase the lot the tree rests on not to be considered during the tree's lifetime. The motion also directed Town staff not to market the surplus lot. The property is the last of 27 Town-owned lots created in 2005/2006 on the flank of former Queen Elizabeth Park School and Queen Elizabeth Park site. While the other lots have been sold off and developed, residents' and council's concern about the protection of the white oak tree has resulted in the property being retained. In January 2013 the Town received an unsolicited offer to purchase the lot. Despite assurances the developer would preserve the white oak, council rejected the offer in May.
