By-election in the offing for late Max Khan's council seat by David Lea Oakville Beaver Staff 13 | Friday, April 3, 2015 | OAKVILLE BEAVER | www.insideHALTON.com The Town of Oakville Clerk estimates it will be July at the earliest -- October at the latest -- before the Ward 6 seat, left vacant by the death of Max Khan, is filled. Khan died on Sunday after going to Oakville Trafalgar Memorial Hospital the evening before with flu-like symptoms. Town Clerk Vicki Tytaneck said the first step to finding a replacement will be taken at the next council meeting on Monday, April 27. That's when it is required by the Municipal Act that the seat be declared vacant. "Within 60 days of that declaration, they can pass a bylaw requiring a by-election to be held or they can make a decision to appoint," she said. Tytaneck said the Town has a policy in place that states, because the next municipal election is so far from now, a by-election must be held. However, it is just a policy, which council could override. If council chooses to appoint a replacement, it is unclear whether it would look at those who ran against Khan during the election or if council could look town-wide for an appointee. "It's not written how they should determine this," said Tytaneck. If council passes a bylaw calling for a byelection, it must set a nomination date within 60 days ­­ by which time everyone seeking the Ward 6 seat would have to be registered. From that point, Tytaneck said, council would have another 45 days to determine a by-election date. Factors that could shorten or lengthen the process include the amount of time needed by Town staff to complete associated paper work. The fact the by-election could fall within the summer months represents a challenge, given that people, who go away for holidays during that time, could miss the vote. Tytaneck said concerns about low voter turnout over the holidays may result in the by-election being postponed until after the summer. With all this taken into consideration, Tytaneck said a Ward 6 councillor could be present as early as July or October as late as October.
