"I will carefully consider your request for a joint panel, under standing that there is no dispute on it and that the municipality and Andrew Bruce have made that request," said 0MB member Donald Granger at a preliminary hearing last week at Town Hall. Six weeks had been set aside this summer into Cityzen/Birchgrove Estates' challenge of a Town of Oakville decision not to allow a high-rise development on the block of land -- including the former Bill Hill marketeria and homestead called Glendella -- on Bronte Road opposite Bronte Harbour. If the answer is no, the OMB has reserved Friday, June 9 to hear arguments from lawyer Ian Lord who is representing the Town, as to why a joint panel should be used. Granger opened last Friday's hearing with the question, "So we haven't settled yet then?" He closed the session saying he'd "be honoured" to be called back to adjudicate over a settle ment as he urged all parties to mediation. However it appears that the parties used Friday to at least map out a game plan as to how they'll disagree. On the eve of an OMB prelimi nary hearing on this case earlier this year, Town council voted to reject the high-rise proposal. On the eve of the hearing, the OMB had worked fast to fold two more appeals into the developers' complaint -- as Town council recently denied two heritage applications to move historic buildings on the Quadrangle to make way for the high rise. * The two new heritage appeals -- and the Town' s reaction to them -- have now taken the over all case down a different path. Whether or not the OMB elects to bring in a heritage expert to constitute a two-person hearing panel, the Quadrangle case will deal with heritage disputes first. Then the OMB will make a decision on the heritage matter. If it' s found the buildings in question -- Glendella and the old Post Office -- can't be moved, the developer would have to bring a new plan to the table. If it' s found the buildings can be moved, Friday, Sept. 8 has been sched uled as the date for another pre-hearing to iron out details and set dates for the remainder of the hearing -- appeals of the Town's* Official Plan, zoning bylaw and site plan that are planning, not her itage, issues. The Quadrangle hearing this summer, will not commence at the start of July as planned, but rather will begin on Thursday, July 12.
